1. Introduction

DevMar Manufacturing, LLC, a limited liability company formed under the laws of the State of Tennessee, United States (together with its affiliates, “we,” “us,” “our,” or the “Company”), respects your privacy and is committed to protecting the personal information you share with us. This Privacy Policy (this “Policy”) explains how we collect, use, disclose, and safeguard information when you visit our website located at https://devmarmfg.com/ (the “Website”), communicate with us, or otherwise engage with our products and services.

Please read this Policy carefully. By accessing or using the Website, you acknowledge that you have read and understand this Policy. If you do not agree with our practices, please do not access or use the Website.

2. Scope of This Policy

This Policy applies to information we collect through the Website and in the course of our business communications, including inquiries you submit, requests for quotes or product information, and correspondence with our sales and support teams. This Policy does not apply to:

• Information collected on any third-party website, platform, or service that we do not own or control, including websites that may be linked from the Website; or

• Information collected offline or through channels not described in this Policy, except to the extent we state otherwise.

Because DevMar Manufacturing serves commercial, industrial, state, and government customers, much of our interaction is business-to-business. This Policy nonetheless describes our practices with respect to all personal information we handle through the Website.

3. Information We Collect

We collect information in three principal ways: information you provide directly, information collected automatically through technology, and information we receive from third parties.

3.1 Information You Provide Directly

We collect the personal information you choose to provide when you interact with the Website or with us, which may include:

Inquiry and transaction information — such as the contents of requests for quotes, product or procurement inquiries, purchase orders, and other details you provide about your needs.

Marketing preferences — your preferences for receiving communications from us, such as newsletter or email subscriptions.

Other information you choose to provide — any additional information you elect to share with us.

• For any other purpose disclosed to you at the time we collect your information or with your consent.

6. Legal Bases for Processing (Individuals in the EEA and UK)

If you are located in the European Economic Area (EEA) or the United Kingdom (UK), we process your personal data only when we have a valid legal basis to do so, including:

Consent — where you have given us consent (for example, to receive certain marketing communications).

Contract — where processing is necessary to perform a contract with you or to take steps at your request before entering into a contract.

Legitimate interests — where processing is necessary for our legitimate business interests and not overridden by your rights, such as operating and improving the Website and securing our systems.

Legal obligation — where processing is necessary to comply with our legal obligations.

7. How We Disclose Your Information

We do not sell your personal information for money. We may disclose your information in the following circumstances:

Service providers — with vendors and service providers that perform services on our behalf, such as website hosting, analytics, email and communications, payment processing, and IT support, who are permitted to use the information only to provide those services to us.

Affiliates — with our affiliated entities, including DevMar Distribution and DevMar Global Healthcare Solutions, for purposes consistent with this Policy.

Business and contractual partners — with partners as necessary to fulfill your requests, such as manufacturing, logistics, and distribution partners.

Legal and regulatory disclosures — when required to comply with applicable law, regulation, legal process, or governmental request, or to respond to lawful requests from public authorities.

Protection of rights and safety — to enforce our agreements and policies, and to protect the rights, property, or safety of the Company, our users, or others.

Business transfers — in connection with, or during negotiations of, any merger, acquisition, financing, reorganization, sale of assets, or other business transaction.

With your direction or consent — for any other purpose disclosed to you with your consent or at your direction.

8. “Sale” and “Sharing” of Personal Information; Targeted Advertising

Certain state privacy laws define a “sale” of personal information, “sharing” or processing for “targeted advertising,” and “profiling” broadly. We do not sell your personal information in exchange for monetary consideration. To the extent our use of analytics and similar technologies could be considered a “sale,” “sharing,” or processing for “targeted advertising” under applicable law, you have the right to opt out as described in Sections 12 through 14. We do not knowingly sell or share the personal information of individuals under the age of sixteen (16).

9. Data Retention

We retain personal information for as long as necessary to fulfill the purposes described in this Policy, unless a longer retention period is required or permitted by law. The criteria we use to determine retention periods include the nature and sensitivity of the information, the purposes for which we process it, applicable legal, accounting, contractual, or reporting requirements, and our legitimate business needs. When information is no longer needed, we will securely delete, destroy, or de-identify it.

10. Data Security

We maintain reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect against accidental or unlawful destruction, loss, alteration, unauthorized disclosure, or access. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You are responsible for maintaining the confidentiality of any credentials associated with your interactions with us.

11. Third-Party Websites and Links

The Website may contain links to third-party websites, products, or services that we do not operate or control. This Policy does not apply to those third parties, and we are not responsible for their privacy practices. We encourage you to review the privacy policies of any third-party websites you visit.

12. Your Privacy Choices and Rights

Depending on where you reside and subject to applicable law and exceptions, you may have some or all of the following rights regarding your personal information:

Right to know / access — to request confirmation of whether we process your personal information and to access that information.

Right to correct — to request correction of inaccurate personal information.

Right to delete — to request deletion of personal information we have collected from you.

Right to data portability — to obtain a copy of certain personal information in a portable, readily usable format.

Right to opt out — to opt out of the sale or sharing of personal information, targeted advertising, and certain profiling.

Right to non-discrimination — to not receive discriminatory treatment for exercising your privacy rights.

Marketing opt-out. You may opt out of receiving marketing emails from us at any time by following the unsubscribe instructions in those emails or by contacting us using the information in Section 18. We may still send you non-promotional communications relating to our ongoing business relationship.

13. State Consumer Privacy Rights

13.1 Tennessee Residents (Tennessee Information Protection Act)

The Tennessee Information Protection Act (“TIPA”), which took effect July 1, 2025, grants Tennessee residents acting in an individual or household context certain rights with respect to their personal information, subject to the statute’s applicability thresholds and exemptions. Where TIPA applies, Tennessee consumers have the right to confirm whether we process their personal information and to access it; to correct inaccuracies; to delete personal information; to obtain a portable copy of personal information they previously provided; and to opt out of the processing of personal information for purposes of targeted advertising, the sale of personal information, or profiling in furtherance of decisions that produce legal or similarly significant effects. To exercise these rights, or to appeal a decision regarding a request, see Sections 13.4 and 18. TIPA is enforced by the Tennessee Attorney General; it does not provide a private right of action.

13.2 Residents of Other States with Comprehensive Privacy Laws

Residents of other states that have enacted comprehensive consumer privacy laws — including, among others, California, Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, Iowa, Delaware, Nebraska, New Hampshire, New Jersey, Minnesota, Maryland, Indiana, Kentucky, and Rhode Island — may have rights similar to those described in Section 12, subject to each law’s scope, exceptions, and applicability thresholds. We honor the rights afforded to residents of these states to the extent the applicable law applies to our processing of their personal information.

13.3 California Residents (CCPA / CPRA)

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”), provides you with specific rights regarding your personal information, subject to certain exceptions:

• The right to know the categories and specific pieces of personal information we have collected, the categories of sources, the business or commercial purposes for collection, and the categories of third parties to whom we disclose it;

• The right to delete personal information we have collected from you;

• The right to correct inaccurate personal information;

• The right to opt out of the “sale” or “sharing” of personal information;

• The right to limit the use and disclosure of sensitive personal information; and

• The right not to receive discriminatory treatment for exercising your CCPA rights.

We do not sell personal information for monetary consideration, and we do not knowingly sell or share the personal information of consumers under 16 years of age. California residents may also have the right, under California’s “Shine the Light” law, to request information about disclosures of personal information to third parties for their direct marketing purposes.

13.4 How to Exercise Your Rights

You, or an authorized agent acting on your behalf, may submit a request to exercise your rights by contacting us using the information in Section 18. To protect your information, we will take reasonable steps to verify your identity before fulfilling a request, which may include asking you to provide information that we can match against information already in our records. We will respond to verifiable requests within the timeframes required by applicable law.

Appeals. If we decline to take action on your request, you may appeal our decision within a reasonable period by contacting us at the address in Section 18 with the subject line “Privacy Rights Appeal.” We will respond in writing with our decision and the reasons for it. If your appeal is denied, you may contact the attorney general of your state to submit a complaint.

Non-discrimination. We will not discriminate against you for exercising any of your privacy rights.

14. Do Not Track and Universal Opt-Out Signals

Some browsers offer a “Do Not Track” (“DNT”) setting. Because there is no common industry standard for how to respond to DNT signals, the Website does not currently respond to DNT signals. Where required by applicable law, we will treat recognized universal opt-out mechanisms (such as the Global Privacy Control) as a valid request to opt out of the sale or sharing of personal information and processing for targeted advertising for the applicable browser or device.

15. Children’s Privacy

The Website is intended for a business audience and is not directed to children. We do not knowingly collect personal information from children under the age of thirteen (13) in violation of the Children’s Online Privacy Protection Act (“COPPA”), or from minors under the age of sixteen (16) without appropriate consent where required. If you believe a child has provided us with personal information, please contact us using the information in Section 18, and we will take appropriate steps to delete it.

16. International Users and Data Transfers

We are based in the United States, and the Website is operated from the United States. If you access the Website from outside the United States, you understand that your information may be transferred to, stored, and processed in the United States and other jurisdictions where our service providers operate, which may have data protection laws different from those of your country. Where required, we implement appropriate safeguards for such transfers.

17. Changes to This Privacy Policy

We may update this Policy from time to time to reflect changes in our practices, technologies, legal requirements, or for other operational reasons. When we make changes, we will revise the “Last Updated” date at the top of this Policy and, whereappropriate or required by law, provide additional notice. We encourage you to review this Policy periodically. Your continued use of the Website after any changes become effective constitutes your acknowledgment of the revised Policy.
